The Green Party of Utah Responds to Attack on Disability Rights by Utah and D.C. Republicans

The Republican assault on disability rights threatens the independence and equality of millions of Americans. The Green Party of Utah (GPUT) stands firm in demanding aggressive implementation of the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act of 1973. We are committed to prohibiting discrimination, enabling people with disabilities to achieve full independence, and ensuring equal educational opportunities for all children.

In Utah the Republican Attorney General is party to a federal lawsuit, with 17 other republican state attorney generals, charging Section 504 of the Rehabilitation Act of 1973 as unconstitutional. At its core, Section 504 requires all programs or activities that receive any federal funding to not discriminate against people based on their disability(ies).1 There are important historic disability civil rights moments related to adoption of Section 504 of the Rehabilitation Act of 1973, a critical milestone in disability rights. If the federal courts agree with the Utah Republicans, would be impossible for government to enforce reasonable accommodation requirements.

On a national level the Trump Justice Department recently revoked 11 ADA Guidelines which had clarified requirements under the ADA, including disability accessibility requirements for hotels and gas stations, some dating back to 1999.2 Revoking the guidance does not mean that requirements under the ADA have changed, but it will make it harder for people to know what the rules are and how they apply. The American Association of People with Disabilities said the department’s move eliminates protections that are “necessary and timely” and the organization is “very concerned about these changes.”

These Republican policies threaten an already fragile support system for people with disabilities. As Adam Guymon, GPUT ADA Coordinator, warns, “Our diagnostic frameworks systematically erase the lived experiences of individuals with emerging disabilities. Disability is a universal human experience that touches every family, community, and generation.” Guymon explains that the International Classification of Diseases, Tenth Revision, Clinical Modification (ICD-10-CM)3 used in the U.S. to code and classify medical diagnoses, presents challenges in diagnosing complex disabilities, creating barriers for those with conditions outside existing categories. Current disability services remain minimal and underfunded, with any further interference threatening disabled persons’ fundamental dignity and independence.

Guymon further emphasizes, “These policies aren’t just political—they directly impact families, workers, and veterans. Disability doesn’t define potential; shortsighted policies do.”

As Lionel Trepanier, GPUT Grassroots Coordinator, declares, “Disability rights are the cornerstone of a just society. When we remove barriers, we don’t just empower individuals—we elevate our entire community.”

These Republican policies allow and promote discrimination against the disabled when the latest CDC data reveals over 70 million adults in the United States, (28.7% of adults) report having a functional disability.4  Nearly half of these persons, more than twelve percent (12.2%) of U.S. adults report a mobility disability with serious difficulty walking or climbing stairs.5 Add also 7.5 million students aged 3-21, representing fifteen percent (15%) of all public school students, who receive special education and/or related services under the Individuals with Disabilities Education Act.6

This is more than an exercise in statistics.  These numbers underscore the fact that people with disabilities are a large part of every community and population. Many of us know, or are, someone with a disability, and disability inclusion is beneficial for all.  Historically, America led the world in establishing a society with democratic values such as equal opportunity and protection from discrimination. Today, however, our country has taken a wrong turn and now is among the most extreme examples of industrialized nations that have a widening gap between the wealthy and the rest of its citizenry — the disabled, the working poor, the struggling middle class, we who increasingly cannot make ends meet.

The GPUT will hold its nominating convention on Saturday, April 27, 2-5pm, Meeting Room B, at the Salt Lake City Library Main, 210 E 400 S, Salt Lake City, UT 84111. The convention is open to the public. Voting in the Presidential Preference Primary will be held in the days following the convention for registered Greens. The GPUT website has detailed information on how to participate. Here is an outline of that information. Follow these stepsIf you are not registered as a Utah voter, be sure to register NOWand check “Green” so you can vote in the GPUT elections.Visit our Voter registration page to learn more. 1. Anytime between now and April 26, so that we have an idea of how many people will attend the convention, please complete the event registration form. You can show up in person without registering. Virtual participation requires registration and the information is at the above link. 2. Anytime between now and April 27, complete the 2024 GPUT Elections Voting Registration, which includes instructions on how to register to vote in Utah, if needed.3. Invest in Green Women for International Women’s Day

International Women’s Day (IWD) inspires a movement that has arisen from the voices of people globally for the rights of women and equality and justice. Women across the planet are demanding accelerated progress as an outcry against sexual harassment, violence, gender gap in wages, and discrimination against women. 

 

The theme for the 2024 IWD is “Invest in Women: Accelerate Progress”, launching a campaign to take a collective stand and unite to transform challenges into opportunities and shape a better future for all“ (1) 

 

The Green Party of Utah (GPUT) joins women world-wide this week and beyond in embracing the opportunity to be part of the movement that empowers women in all settings to raise up their voices and take action for women’s rights, and to realize the potential of women, given barriers that stand in the way. To that end the GPUT joins in the call for everyone to make a concentrated effort to act in these five areas:

  • Investing in women, a human rights issue: Gender equality is the greatest human rights challenge, benefiting everyone.
  • Ending poverty: Due to the COVID pandemic and conflicts, 75 million more people have fallen into severe poverty since 2020. Immediate action is crucial to prevent over 342 million women and girls living in poverty by 2030.
  • Implementing gender-responsive financing: Conflicts and rising prices may lead 75% of countries to cut public spending by 2025, negatively impacting women and their essential services.
  • Shifting to a green economy and care society: The current economic system disproportionately affects women. Advocates propose a shift to a green economy and care society to amplify women’s voices.
  • Supporting feminist change-makers: Despite leading efforts, feminist organizations receive only 0.13% of official development assistance (1)  

By just living in Utah, we are already at a disadvantage as women. Utah women have unique challenges in that Utah is still the worst state in the country for women’s equality.(2) Utah’s women still lag behind men in wages for equivalent work and continue to be underrepresented in Utah’s politics. Women often do not have an influential voice on issues that directly impact women in Utah, particularly in the areas of health and domestic violence. This is unacceptable!

 

I want a brighter future for my daughter and granddaughters.

 

The Green Party’s ten key values align with the call for action of IWD. Feminism And Gender Equity is one of the ten key values.(4)

 

We have inherited a social system based on male domination of politics and economics. We call for the replacement of the cultural ethics of domination and control with cooperative ways of interacting that respect differences of opinion and gender. Human values such as gender equity, interpersonal responsibility, and honesty must be developed with moral conscience. We recognize that the processes for determining our decisions and actions are just as important as achieving the outcomes we want.

 

The GPUT calls for the acceleration of progress with the investment in women by taking action now to protect their rights, especially women of color, LGTBQIA+, women with disabilities and women of varying socioeconomic statuses. I encourage Utah women, and women everywhere, to take a stand and speak out in a state where women do not have a powerful voice.  

 

More education and involvement of women in the political process is needed to influence policies that affect women in all areas. Women are the backbone of human life in Utah. We call for all women in Utah to raise their voices against oppression, violence, and discrimination. We call for all Utah women to become involved in advocacy organizations to learn how to speak up and demand justice.  We call for all Utah women to run for office and develop legislation that will provide the needed political actions to end disparities between women and men.

 

Join me and the GPUT today in this call for action to invest in Green women and accelerate progress!
